Ali Yildiz has successfully defended a case before the UN Committee against Torture against Sweden, which had rejected the asylum applications of a Turkish citizen and decided to return them to Kosovo, his last country of residence.
Avukat Ali Yıldız, İsveç’in iltica başvurusunu reddederek Kosova’ya geri gönderme kararına karşı BM İşkenceye Karşı Komite’de açtığı davayı kazandı. Komite, başvurucunun Kosova’ya deport edilmesinin Türkiye’ye iade riski taşıdığına ve non-refoulement prensibini ihlal ettiğine karar verdi.
Avukat Ali Yıldız, bir Türk çiftin iltica başvurularını reddederek geldikleri Kosova’ya geri gönderme kararı alan İsviçre’ye karşı BM İşkenceye Karşı Komite nezdinde açtığı davayı kazandı. Şikâyetçilerin sınır dışı edilmesini önlemek için geçici tedbir kararı almış olan Komite, son oturumunda İsviçre makamlarının kararlarında hatalı olduğu sonucuna vardı.
Ali Yildiz has successfully defended a case before the UN Committee against Torture against Switzerland, which rejected the asylum applications of a Turkish couple and decided to return them to Kosovo, where they came from.
The Committee, which has already issued an interim measure to prevent the deportation of the complainants, concluded at its last session that the Swiss authorities erred in their decisions.
